1. OVERVIEW

This website (marahealth.co) is operated by Mara ("we," "us," "our"). By visiting our site or buying from us, you agree to these Terms, our Refund Policy, Shipping Policy, Subscription Policy, and Privacy Policy. If you do not agree, do not use the site.

2. ELIGIBILITY

You must be at least 18 years old and able to form a binding contract to place an order.

3. PRODUCTS

Our products are wellness products. They are not intended to diagnose, treat, cure, or prevent any disease. Statements on this site have not been evaluated by the Food and Drug Administration. Talk to your doctor before use if you are pregnant, nursing, have a thyroid or iodine-related condition, or take medication. Results vary.

4. ORDERS AND PRICING

All orders are subject to acceptance. We may refuse or cancel any order, limit quantities, and fix pricing or listing errors at any time, including after an order is placed. If we cancel after you were charged, we refund you in full.

5. SUBSCRIPTIONS AND AUTOMATIC RENEWAL

Some products are sold as subscriptions. If you choose a subscription:

  • You authorize us to charge your payment method automatically on a recurring basis, at the price and frequency shown at checkout, plus any taxes and shipping shown, until you cancel.
  • The renewal price, billing frequency, and how to cancel are shown next to the subscribe option and at checkout before you pay.
  • You can cancel any time, online, through the "Manage Subscription" link at the bottom of every page or by emailing marahealthco@gmail.com. To avoid your next charge you must cancel at least 24 hours before your next billing date.
  • We email you a receipt after every charge and a reminder before each renewal.

6. RECORDS AND ELECTRONIC CONSENT

You agree that checking a box, clicking a purchase button, or submitting payment is your electronic signature and consent to these Terms. To protect you and us from fraud, we keep records of every order, including the date and time, IP address, device and browser details, the terms and disclosures shown to you, your subscription consent, order and account activity, emails sent to you, and carrier delivery confirmation. You agree these records may be used as evidence of your purchase and authorization, including in any payment dispute.

7. PAYMENT DISPUTES AND CHARGEBACKS

If you have any problem with a charge, you agree to contact us first at marahealthco@gmail.com and give us 5 business days to resolve it. Most issues are fixed within 24 hours, including refunds under our guarantee. Filing a chargeback for an order you authorized, received, or could have refunded directly with us is a breach of these Terms. In that case we will dispute the chargeback by sending our records to your bank, and we may cancel your active subscriptions, block future orders, and recover any amounts and fees owed to us as allowed by law.

8. SHIPPING AND RISK OF LOSS

Title and risk of loss pass to you when the carrier confirms delivery to the address you provided. See our Shipping Policy.

9. INTELLECTUAL PROPERTY

All content on this site, including text, images, videos, logos, and product names, belongs to Mara and may not be copied or used without written permission.

10. PROHIBITED USES

You may not use this site for any unlawful purpose, to commit fraud, to resell our products without permission, to submit false information, or to interfere with the site's security.

11. DISCLAIMER OF WARRANTIES

Except as required by law, the site and all products are provided "as is" and "as available" without warranties of any kind, express or implied.

12. LIMITATION OF LIABILITY

To the fullest extent allowed by law, Mara is not liable for any indirect, incidental, special, punitive, or consequential damages. Our total liability for any claim will not exceed the amount you paid for the order in question.

13. INDEMNIFICATION

You agree to defend and hold Mara harmless from claims, losses, and costs (including reasonable attorneys' fees) arising from your breach of these Terms or violation of law.

14. DISPUTE RESOLUTION AND ARBITRATION

Please contact us first; we resolve almost everything informally. If we cannot resolve a dispute within 30 days, you and Mara agree to resolve it by binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules, instead of in court. Either party may bring a qualifying claim in small claims court instead. YOU AND MARA WAIVE ANY RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION. You may opt out of this section by emailing marahealthco@gmail.com within 30 days of your first purchase.

15. GOVERNING LAW

These Terms are governed by the laws of the State of New York and applicable federal law, without regard to conflict-of-law rules.

16. TERMINATION

We may suspend or end your access to the site or cancel subscriptions if you violate these Terms.

17. SEVERABILITY AND ENTIRE AGREEMENT

If any part of these Terms is found unenforceable, the rest stays in effect. These Terms and the policies they reference are the entire agreement between you and Mara.

18. CHANGES

We may update these Terms at any time by posting them here. Changes apply to orders placed after the update. Changes to your subscription price will be emailed to you before they take effect.
